Arizona Voters Launch Campaign to Remove Supreme Court Justices Clint Bolick and Kathryn King Following Controversial Abortion Ruling

Arizona’s Constitution Allows Voters to Step In when Judges Overstep

PHOENIX – In a swift response to the Arizona Supreme Court's decision to uphold a law from 1864 that totally bans abortions, while mandating 2-5 years in prison for anyone who helps someone access an abortion, outraged Arizona voters initiated a campaign to unseat Supreme Court Justices Clint Bolick and Kathryn H. King. 

The campaign, spearheaded by Progress Arizona, aims to leverage Arizona’s unique judicial retention elections as outlined in the state’s constitution. 

Bolick and King are already slated to face voters this coming November. If more than 50% of voters choose not to retain the justices, their seats will be vacant, and Arizona’s Governor will appoint new justices.

Abigail Jackson of Progress Arizona, stated, “When judges overstep, Arizona’s constitution empowers voters to step in. In extraordinary circumstances like the ones we are in today, removing judges who serve ideology over the people is not just a constitutional right, it is a civic duty. It’s up to voters to preserve the integrity and balance of the judicial system.” 

Criticism of the court's ruling was not limited to those who support abortion rights. 

Republican Congressman David Schweikert posted on X that the Supreme Court’s ruling was “legislated from the bench.” 

Republican State Senator TJ Shope also criticized the Arizona Supreme Court ruling because they “ignored our legislative intent.”

In 2016, Arizona Governor Doug Ducey expanded the Arizona Supreme Court from five to seven justices, a highly partisan move that politicized the judiciary by packing it with justices aligned with one partisan viewpoint. With Wednesday’s ruling, Arizonans are now paying the price.
